Interlocks for DUI Offenders

Study Finds Ignition Interlocks Reduce Drunk Driving Deaths

When you get a DWI or DWAI in New York, you will be required to get something called an ignition interlock device. While these devices can be a nuisance, the Insurance Institute for Highway Safety (IIHS) reports that they are saving lives. NYC drunk driving lawyers are here to help when you have been accused of DWI, but remember, it is not just about beating your charges. Many people who are charged with DUI or DWI have serious and life-altering alcohol dependency and addictions.

Alcoholism is serious and requires effective treatment. Repeat offenders with multiple DUI convictions can face severe prison terms, permanent loss of their license, and countless fines and court costs. If you are struggling because of DUI penalties and charges, call the lawyers at 888-DUI-Lawyer now.

New York’s Leandra’s Law

Following passage of this law in New York, all drivers convicted of DWI on or after August 15, 2010 will be required to have an ignition interlock device installed in their vehicle. Likewise, they will have a restriction placed on their license. This can last for at least a year.

How do Ignition Interlocks Work?

The ignition interlocking device is designed to keep your vehicle from turning on until it registers that your BAC is below a certain threshold. New York devices are designed to prevent the vehicle’s ignition from functioning until the BAC is below 0.025%. So, basically any alcohol will keep it from turning on.

Once the engine is running, the system will periodically require the driver to provide another breath sample. If the driver does not comply, the system will begin making the horn honk and a loud audible alarm will go off until the driver pulls over and turns off the vehicle or until it receives a clear breath. Some of these devices come equipped with cameras, and they all record data.

Cheating the Device is a Crime

If you have an IID restriction on your license, it is illegal to drive without one. So, you cannot drive other people’s vehicles, unless they are also equipped with IID devices. Breathing into an IID for someone else is a Class A misdemeanor that carries up to a one-year jail term.

How do Ignition Interlocks Save Lives?

New York is among the 45 states that currently use ignition interlock devices. IIHS reports that in states where the devices are in use, deaths involving BAC above 0.08 have gone down drastically.

In states that only require interlocks for repeat DUI offenders, they have seen a 3% reduction in fatalities. In states that require them only for repeat offenders and those with high BACs (elevated BAC), they saw an 8% reduction in fatalities. However, states like New York, which require interlocks for all DUI offenders – including first timers – they have seen an overall reduction by 16%. If all states followed this stricter rule, the report suggests that as many as 543 lives could have been saved in 2016 alone.
